Gardening Services Agreement

This “Agreement” is made between we, the service provider:  PLANT THIS LLC and Jonathan Giese, 693 E Sunny Dunes Road, Palm Springs, CA 92264 and you, the client. 

1. Services Provided

Plant This, LLC agrees to provide the following gardening services at the Service Address(es) on a biweekly basis (twice per month), starting June 10th 2025 and continuing on the second and fourth Tuesdays. 

The regular bi-weekly service shall include:

• Light trimming of shrubs, plants, and small trees (under 9 feet).
• General garden tidying, including weeding and cleanup.
• Removal of light debris (e.g., leaves, trimmed branches).
• Occasional hand-watering as needed (not full irrigation services).

Exclusions: Heavy tree trimming, pruning, lighting or irrigation system repairs, pest control, and major landscaping projects are not included but can be quoted separately upon request.

2. Service Schedule

Services will continue every other Tuesday as mutually agreed upon by Plant This, LLC and the Client after signing this Agreement, unless rescheduled due to inclement weather, holidays, or other unavoidable circumstances. Plant This, LLC will make every effort to notify the Client in advance of any schedule changes.

3. Payment Terms

The Client agrees to pay a flat monthly fee of $700 for both properties, auto-billed on the 1st of each month via  PayPal, Apple Pay, Shop Pay, or Credit Card.

• Late payments (after 7 days) may incur a $25 late fee.
• Services will not be performed if payment is overdue by more than 14 days, and the Client remains responsible for the monthly fee.

4. Property Access and Conditions

The Client agrees to:

• Provide access to the garden on scheduled service days, including unlocked gates and clear pathways.
• Provide green or black trash bins for light debris, (additional haul offs if necessary will be charged at $300 per load)
• Ensure outdoor water sources are accessible if hand-watering is needed.
• Maintain a safe working environment free of hazards, including pet waste

If access is unavailable or conditions are unsafe, Plant This, LLC may skip the service without rescheduling or refunding for that service date.

PET WASTE CLAUSE:  If any pet or animal feces are present in the work area during a scheduled visit, Plant This, LLC will immediately cease work, leave the property, and the client will forfeit service (and associated fee) on that date.  Client is responsible for ensuring the work area is free of pet waste prior to each visit.

5. Cancellation and Termination

Either party may terminate this Agreement with 30 days’ written notice (email or text acceptable). The Client is responsible for payment for all services provided prior to termination.

If the Client cancels a scheduled service with less than 24 hours’ notice, the full service fee for that date may be charged.

6. Liability and Limitations

Plant This, LLC will perform all services with reasonable care and skill. However, we are not liable for:

• Damage to underground utilities (e.g., irrigation lines, cables) unless caused by our proven negligence.
• Pre-existing garden conditions or plant health issues.
• Damage due to extreme weather, pests, or other factors beyond our control.

The Client is encouraged to carry appropriate property insurance for their garden and outdoor areas.

7. Plant Replacement

Plant This, LLC is not responsible for replacing plants that die due to: natural causes, pests, insufficient irrigation, or any other factor beyond our control, including extreme weather—unless caused by proven negligence. 

Replacement services, including plant selection and installation, can be quoted separately upon request.

8. Seasonal Add-On Services

Other services, such as fertilizing, mulching, and seasonal plantings, can be provided for an additional fee which will be quoted separately based on the Client’s needs and the scope of work.

9. Force Majeure

Plant This, LLC is not liable for delays or inability to perform services due to events beyond our control, including but not limited to extreme weather, natural disasters, or government restrictions.

10. Entire Agreement

This Agreement represents the full understanding between the Client and Plant This, LLC. Any changes must be made in writing and signed by both parties.
